1        Introduction and Acceptance of Terms of Use

The terms and conditions set out below apply to the use of this web site and contain important information about the ordering, purchase, fulfilment and delivery of products from Carrick Family Bookshop.

Our web site offers you a wide range of content, communication tools, and information about its products and services. By using this web site you are entering into a legally binding Agreement between Us and You for the supply of products from the time of placing your order through to the fulfilment of your order. This agreement cannot be altered or varied unless we agree to alter or vary it in writing or by email.

 

Carrick Family Bookshop reserves the right to review and update these Terms and Conditions as needed at any time without notice. Any modifications to this Policy in whole or in part will be effective immediately upon posting of the amended Terms and Conditions of Use on this website. 2        Legal Capacity

If you are less than eighteen (18) years of age you cannot place Orders with Carrick Family Bookshop. By accepting this Agreement you acknowledge that you are over the age of eighteen (18) years.

 

3        Terms and Conditions of Sale

Pricing

  • All prices are quoted in Australian dollars and are inclusive of GST.
  • While our company endeavours to keep to the listed prices we do reserve the right to alter prices without notice.
  • From time to time prices can differ to those displayed on the web site, especially when products are out of stock or on order, as new pricing structures can happen when receiving new stock into our system.
  • If you are uncertain of prices please contact us before placing your order.

Ordering

  • Carrick Family Bookshop uses reasonable endeavours to ensure this web site, and any transactions conducted on it, are secure. The customer agrees to indemnify, defend and hold Carrick Family Bookshop harmless from and against any and all third party claims, liabilities, damages, losses or expenses arising out of, based on or in connection with your access and/or use of material and transactions conducted on this web site.
  • By placing an order you are entering into an agreement to purchase the product(s) which are the subject of your order.
  • Carrick Family Bookshop retains ownership of all products ordered by you until full payment has been received for those products from you the customer.
  • Carrick Family Bookshop shall not be liable for any delays in performing any of its obligations to you if such delays are caused by circumstances beyond our reasonable control or the reasonable control of our affiliates. In such circumstances we shall be entitled to a reasonable extension of time for the performance of our obligations to you.

Cancelling Orders

  • You have the right to cancel your order, or part thereof before dispatch within reasonable time, unless you have made a special order, whereby we have needed to place a special order on your behalf with our suppliers and are unable to rescind that order for you.
  • Despite our best efforts to ensure prices stated on the web site are kept accurate, sometimes incorrect prices are quoted. In the case of such errors (subject to applicable law that cannot be excluded), we will not be bound by the incorrect pricing stated and reserve the right to cancel you order prior to despatch.
  • Please note that Carrick Family Bookshop may, at its sole discretion, terminate your order before shipment and your access to this website at any time. In the event of a cancelled order no funds will be processed and you have not been charged. You will be notified of the cancellation via email.
  • If in the event of having placed your order(s) online, we find that all or some of the products are no longer available for that order(s) to be fulfilled you will be advised either by telephone or email.
  • Carrick Family Bookshop will not accept any responsibility for orders that are illegible, declined, delayed or not accepted due to disruptions with internet or phone connections.
  • Despite our best efforts to deliver your products in a timely manner other factors outside of our control may result in delays. Carrick Family Bookshop does not accept any liability for any loss or damages to you as a result of any such losses or delays out of our control.

Stock Availability

  • Carrick Family Bookshop does not stock all of the products all of the time on this website. From time to time some of the products listed on this web site might not be available any longer or out of print, in which case we do try to take them off display. Despite our best efforts, sometimes items are overlooked and errors do occur. We reserve the right to cancel any order for products that are no longer available or that we cannot source.
  • Some of the products displayed on our web site are not items that we keep in stock at our office and need to be ordered in from our warehouses. If an item is displayed as out of stock or unavailable please contact us for availability and delivery times. Sometimes these items will be denoted with the words warehouse stock item. Check if urgent.

Stock Descriptions

  • Despite our best efforts to provide accurate and detailed descriptions, dimensions and images of our products they can only be approximate and new stock ordered in from our suppliers may at times be different to that described on our web site. If you receive a product that is vastly different to that described on the web site please contact us within 10 business days of receipt of your purchase to discuss if it is eligible for a return or exchange.
  • It is worth noting that images displayed on the web site are not to exact sizes and dimensions should be checked before ordering. If uncertain please contact us.

Out of Stock Items

  • If an order is made by you, whereby some or all of the items are out of stock and need to be bought into stock on your behalf, the price can sometimes differ to that of the listed price due to altered prices with our suppliers when buying in new stock. Please contact us if you are uncertain of pricing of products displayed, especially concerning out of stock products.
  • If some or all of the products on your order are out of stock at our store at the time of your order, your order will be placed on a back order shelf and sent to you when all of the stock has arrived into stock and we are able to fulfil your complete order. If this process is going to take longer than 10 working days you will be notified via email or telephone. If this process does not suit your purposes please contact us on 1800 813 022 or email to carrickfamilybooks@bigpond.com.
  • If your order is URGENT please state this in the comments section online or let us know via the above contacts.

Special Orders

  • All made to measure or special orders, such as items brought into stock solely for your special requirements, e.g. Statues, special candle orders, large book/bible orders or customised products, are on a firm order sale only and cannot be returned, replaced, given credit for, or exchanged unless received in a faulty or broken condition as required by law. If this be the case, no credits, replacements, returns or exchanges will be accepted without prior authorisation from our returns department.

Sale Items and special offers

  • All items placed on sale or placed in the specials or bargain box are only valid on our web site for as long as they are displayed as being in stock or until sold out.
  • Sale items have no further discounts unless expressly stated on the web site.
  • Sale items cannot be ordered into stock and are only available until stocks last.
  • Sale, specials or bargain box items cannot be returned, credited or exchanged and are sold on a strictly firm sale basis only.

Shipping

  • Carrick Family Bookshop uses e-parcel to dispatch all parcels. Every parcel dispatched is issued with a tracking number. If you are concerned about a dispatch of an order that is delayed more than one week please contact us regarding your tracking number. It is the customers’ responsibility to liaise with Australia Post in relation to date and time of delivery. We will not be held responsible for any inaccurate information provided in relation to date and time of delivery.
  • Please note all small and large letters are exempt from the previous clause and do not have a tracking number provided.
  • For special orders or large, heavy or bulky orders the flat rate despatch fees listed on the shipping rates page do not apply. Please contact us to arrange the shipping costs.

Communication of Supplied Information

  • You are solely responsible for the content of your information when communicating with Carrick Family Bookshop.
  • Carrick Family Bookshop will not be liable in any way for information entered incorrectly by you on our website when ordering and shall not be held responsible for the delivery or supply of such orders.
  • Where you have entered incorrect information such as an incorrect delivery address for your order you may be charged a redelivery fee for each subsequent delivery attempt.
  • You are solely responsible for updating any changes to your details (eg. change of address) to Carrick Family Bookshop. We will not be responsible for out of date or incorrect details supplied by you (the customer).
  • Carrick Family Bookshop will not refund or resend products to customers who have provided incorrect or incomplete addresses and all responsibility for correcting delivery will be held with you the customer.
  • Carrick Family Bookshop is mainly a mail order and online business and will communicate with its customers primarily via email and telephone. Therefore it is your responsibility to ensure correct details are entered when making an order(s) and that the nominated email address and telephone number(s) is regularly checked for correspondence.

Payment

  • We accept payment by Visa/MasterCard, EFT payments and cheque.
  • We do not recommend that you pay by cash through the mail. We accept no responsibility for theft, loss or otherwise of cash or cheques sent through the mail and the goods ordered remain the property of Carrick Family Bookshop until we have received payment in full.
  • We do not recommend that you send your credit card details by email as this is not a secure payment option. We do not accept any responsibility for theft, loss of revenue or otherwise to you when credit card details have been sent via email.
  • Secure credit card payment options are available during the checkout process on our website or you can phone your details to 1800 813 022.
  • If you have incorrectly paid for your order via EFT (bank transfer) to an incorrect account number, Carrick Family Bookshop will not accept any responsibility for correcting payment and the goods will remain the property of Carrick Family Bookshop until paid in full into the correct account number.
  • Payment for orders using credit card are processed by Eway.
  • If credit card details submitted by you are rejected by our payment gateway for any reason, you will be contacted to confirm additional details, or to rescind the transaction if you do not provide the requested information within up to 7 days of us contacting you either by telephone or email.
  • Invoices are dispatched with goods if you are a 30 day account holder. All account holders will be issued with a monthly statement. All accounts are strictly thirty (30) day accounts.
  • Carrick Family Bookshop reserves the right to put a stop on all accounts unpaid on 60 days until the full 30 day and 60 day amounts are paid in full.

 

4        Terms and Conditions for Credits, Refunds and Returns

Authorisation of Returns

  • No returns, credits, refunds or exchanges will be accepted without prior authorisation.
  • Any product(s) returned to us without our authorisation may incur administration and handling fees as this falls outside our returns policy.

Defective or Damaged Goods Returns

  • All returns of defective, incorrect or damaged goods are eligible for our shipping expenses. You will need to apply to us for our returns authorisation shipment label which needs to be adhered to the front of the parcel in a clear flat layout without any creases so that the barcode may be read easily by Australia Post employees.
  • All claims must be made within ten (10) business days of the date of the invoice or purchase.
  • All refunds or credit may take up to ten (10) business days to be processed when the product(s) have been received back into stock by Carrick Family Bookshop.
  • Carrick Family Bookshop will replace, give credit or refund faulty or damaged goods or products that have been supplied incorrectly by us, when proof of purchase and proof of damage are provided by the customer within the given time specified above. Please retain your invoice and/or receipt as proof of purchase of products.
  • Goods sold on a non-returnable basis cannot be returned unless faulty or damaged. Such goods would include all items sold as a ‘Special Order’ or on a ‘Sale’ or ‘Specials’ basis or sold for resale purposes.

Product Returns

  • Returned products must first of all be authorised by our returns department and be returned in their original unopened packaging with all accessories and must be received by us in a re-saleable condition. If you are returning a product because it does not meet your expectations or you have changed your mind you will be responsible for the full cost of delivery in returning that product. Please note, you cannot return goods that have been sold as ‘specials’ or ‘sale items’ or ‘custom or made to order items’ because you have changed your mind unless they have been received as damaged or faulty.
  • All returns that are your responsibility for shipment costs should be clearly marked and returned to:

  • Please include your return address on the back of the parcel.
  • We take no responsibility for returns lost in transit back to us. You will only be reimbursed for goods returned to us in a resalable condition.
  • If you are returning a product due to a fault or defect you may do so without its original packaging. Please contact us for a returns label authorisation for all faulty or damaged stock.
  • Sales to account holders for resale purposes are non-returnable and sold on a firm sale basis only, unless damaged, faulty or incorrectly supplied.
  • Cosmetics cannot be returned for credits or refunds.
  • Software, audio and visual items usually cannot be returned for a refund, credit or exchange if opened or tampered with. This does not affect your rights if the product(s) is damaged or faulty. Some of these products are sourced from foreign countries. You (the customer) should be aware that some DVD’s and software may not play on your devices due to regional code differences. It is your responsibility to ensure that your DVD player or device is capable of playing ‘region free’ discs or software and Carrick Family Bookshop will not be held responsible for the return, replacement or refund of DVD’s and software that do not play in your device.
  • Carrick Family Bookshop does not warrant any software or other electronic or digital products under our Terms and Conditions, as all warranties for these products are in accordance with the license agreement that governs its use.
  • Customers are permitted to cancel their order at any time prior to dispatch of the product(s), provided that the order was not placed as a ‘special order’.
  • A ‘special order’ can only be ordered and agreed upon by you, the customer, and Carrick Family Bookshop, as a firm sale order and cannot be rescinded.

 

5        Communications

  • Except for any disclosure by you as specified in our Privacy Statement, all communications from you to this web site will be considered non-confidential and non-proprietary.
  • You agree that any and all comments, information, feedback and ideas regarding our company, products or services that you communicate to Carrick Family Bookshop (“Feedback”) will be deemed, at the time of communication to Carrick Family Bookshop, the property of Carrick Family Bookshop and Carrick Family Bookshop shall be entitled to full rights of ownership, including without limitation, unrestricted right to use or disclose such Feedback in any form, medium or technology now known or later developed, and for any purpose, commercial or otherwise, without compensation to you.
